| 无居民海岛作为一种独特的自然资源，不仅蕴藏着巨大的经济价值，更因其相对隔绝的自 然地理环境而具有重要的生态价值和战略价值。党的二十大以来，在加快建设海洋强国的战略部 署下，无居民海岛保护工作已正式提上日程，亟待进一步加强。但是，在无居民海岛上违法建筑 的查处这一具体问题上，仍缺乏明确的法律规定，存在查处主体不清晰、查处标准不统一、查处 程序不规范的问题。文章聚焦我国无居民海岛上违法建筑查处难题，结合具体案例进行深入剖 析，着力规范与细化无居民海岛上违法建筑查处主体、查处标准与查处程序，以期完善无居民海 岛上违建查处行政执法，助力海岛生态保护与海洋强国建设。 |

| Uninhabited islands，as unique natural resources，possess not only significant economic value but also unparalleled ecological and strategic value due to their relatively isolated geographical environment. Since the 20th National Congress of the Communist Party of China，under the broader context of stepping up efforts to build China into a strong maritime country，the protection of uninhabited islands warrants further strengthening． However，in the specific issue of investigating and penalizing illegal buildings on these islands，there remains a lack of clear legal stipulations，resulting in issues such as unclear enforcement entities，inconsistent enforcement standards，and non-standardized enforcement procedures. This paper focuses on the challenges of investigation and punishment of illegal buildings on China’s uninhabited islands. Through in-depth analysis of specific cases， it aims to standardize and refine the enforcement entities，standards and procedures for handling such illegal buildings．The goal is to continuously optimize the administrative enforcement of law against illegal buildings on uninhabited islands，thereby contributing to island ecological protection and the construction of a strong maritime country. |
